I am thinking of creating a pop-up with information guests have to consent to. Does anyone have that now?

Right now, we have the following just above the make reservation button...
By clicking on 'Make Reservation' below you are agreeing to the Reservation Policies and Cancellation Policy. The Res policy and cancellation policy are both links for pop up boxes that give the information.

The best thing to do now is to have your policy showing on the reservation area. Some innkeepers have lost chargebacks because of having the link instead of having it right there where the acceptance box is. ResKey now has that option.

It's actually in the hotel/inn merchant agreement.

In the example given, which I find stringent cancellation policies, if I didn't see it and agree to it clearly I would fight paying that "penalty" as it is not typical, imo for overnight lodging.
So I think this is a good thing, and thank you for pointing it out for all of us to double check what a guest sees when booking a room online.

Thanks for drawing this to my attention. This needs to be changed...The place used to be for long term rentals only.:-(

Here's what we did -- links to the detailed policies, but included the text of the cancellation policy right on the reservation page.

And actually, the pop-up for the Rental Agreement is just the highlights, there is a link from that to the fully-detailed policy page....

We also have the click box and the full Cancellation Policy showing, along with links to Policies & Cancellations.
